In accordance with relevant Chinese laws and regulations, as well as the provisions on phytosanitary requirements for peanuts exported from Laos to China reached between the General Administration of Customs of the People’s Republic of China (hereinafter referred to as the Chinese Side) and the Ministry of Agriculture and Environment of the Lao People’s Democratic Republic (hereinafter referred to as the Lao Side), import of peanuts from Laos that meet the following requirements shall be permitted with immediate effect.

I. Basis for Inspection and Quarantine

(1) Biosafety Law of the People’s Republic of China; (2) Law of the People’s Republic of China on the Entry‑Exit Animal and Plant Quarantine and its Implementing Regulations; (3) Food Safety Law of the People’s Republic of China and its Implementing Regulations; (4) Measures for the Administration of Import and Export Food Safety of the People’s Republic of China; (5) Protocol between the General Administration of Customs of the People’s Republic of China and the Ministry of Agriculture and Environment of the Lao People’s Democratic Republic on Phytosanitary Requirements for Peanuts Exported from Laos to China.

II. Name of Commodities Permitted for Entry

Peanut (Arachis hypogaea) referred to in this Announcement means shelled peanut seeds grown and processed in Laos for human consumption or food‑processing use, not intended for sowing.

III. Approved Producing Areas

The whole territory of Laos.

IV. Enterprise Registration

The Lao Side shall ensure that enterprises engaged in production, processing and storage of peanuts exported to China satisfy China’s inspection and quarantine requirements, recommend qualified enterprises to the Chinese Side. Enterprises approved by the Chinese Side will be registered, and the enterprise list will be published on the website of the General Administration of Customs and updated dynamically.

V. Pests of Concern to China

Peanuts exported to China shall be free from the following pests:

1. Trogoderma granarium
2. Cenchrus echinatus
3. Eupatorium odoratum L.
4. Mikania micrantha

VI. Pre‑shipment Requirements

(I) Production requirements

1. The Lao Side shall supervise peanut growers, processors and storage operators to establish an integrated pest management system to reduce the occurrence level of pests of concern to China.
2. The Lao Side shall conduct supervision over peanut‑exporting enterprises to ensure that cleaning measures such as screening are adopted during peanut collection, storage, processing, transportation or before shipment, so that peanuts exported to China are free from plant residues, impurities and seeds of dangerous and toxic weeds.

(II) Packaging and transportation requirements

Peanuts exported to China shall be packed to prevent spillage and contamination during transport. Packaging materials must be clean, hygienic, first‑time used and free from toxic and harmful substances. Each package shall be marked in both Chinese and English with the statement “本产品输往中华人民共和国 / This consignment is exported to the People's Republic of China”, together with product name, place of origin, name of the production‑processing‑storage enterprise and its Chinese‑side registration number and other information.

(III) Pre‑export inspection, quarantine and certification requirements

Prior to export, the Lao Side shall carry out inspection and quarantine on peanuts for export to China. A phytosanitary certificate shall be issued for consignments complying with requirements. An additional declaration shall be printed on the certificate:

This consignment complies with the phytosanitary requirements described in the Protocol for Peanut from Laos to China, and is free from pests of concern to China.

The name of the production‑processing‑storage enterprise and its Chinese‑side registration number shall also be indicated on the certificate. If live pests are detected, fumigation treatment shall be carried out before export, and information including chemical name, dosage, temperature and duration shall be stated on the phytosanitary certificate.

VII. Entry Inspection and Quarantine

(I) Documentation verification

1. Verify whether the consignment originates from a registered enterprise;
2. Verify the authenticity and validity of the phytosanitary certificate.

(II) Cargo inspection

Inspection and quarantine shall be carried out on peanuts in accordance with relevant laws, administrative regulations, rules and this Announcement. Goods shall be released for entry after passing inspection‑and‑quarantine.

(III) Disposal of non‑compliant consignments

1. Consignments without valid phytosanitary certificates shall be returned or destroyed;
2. Consignments from non‑registered enterprises shall be returned or destroyed;
3. Consignments failing safety‑sanitation indicators such as aflatoxin exceeding the limits set by China’s national food‑safety standards shall be returned or destroyed;
4. If pests of concern to China are found, consignments may be granted entry after successful disinfection treatment; where no effective treatment is available, consignments shall be returned or destroyed;
5. Where other non‑compliance with China’s entry‑exit plant quarantine, food‑safety laws, regulations or standards is identified, relevant measures shall be taken in accordance with applicable provisions.

In case of any above‑mentioned non‑compliance incidents, the Chinese Side shall notify the Lao Side. Depending on the severity of the violation, export qualification of the relevant enterprise may be suspended until the Lao Side takes effective corrective measures.
